For purposes of this Agreement: “we,” “us,” “our,” or “the company” refers to American Modern Insurance Group, Inc. and its subsidiary companies (“American Modern”) unless otherwise indicated by specific reference to a particular company. These subsidiaries include, but are not limited to, American Modern Property and Casualty Insurance Company, American Modern Home Insurance Company, American Family Home Insurance Company, American Modern Select Insurance Company, American Southern Home Insurance Company, American Modern Lloyds Insurance Company, American Modern Insurance Company of Florida, Inc., and American Western Home Insurance Company. “You and “Yours” refers to the owner(s) of one or more policies/accounts issued or offered by any one of us and the recipient of any messaging covered by this Agreement.  You agree that you are 18 years or older and either the subscriber to the phone number provided to American Modern or otherwise properly authorized to enroll and receive messages from American Modern Messaging Services. American Modern provides Messaging Services, including text messaging, as described in this Agreement, as a convenience to you for your private use, however we reserve the right to terminate Messaging Services, in whole or in part, at any time without notice.

Your Consent

By clicking “Enroll” in American Modern Messaging Services, as your electronic signature, you agree to be bound by these terms and conditions, including the most current version, available here [hyperlink]. The terms and conditions are subject to change, with or without notice, and at American Modern’s sole discretion. IF YOU DO NOT AGREE WITH THESE TERMS AND CONDITIONS, PLEASE DO NOT ENROLL IN AMERICAN MODERN MESSAGING SERVICES. Your consent to receive messages is not a condition to purchase a policy from American Modern, however your ability to send and receive messages may vary by your carrier and message and data rates charged by your carrier may apply.

Messages may vary. We may, for example, send you unencrypted messages regarding policy notifications, billing notifications, or claims information. As such, messages may include information pertaining to your account or policy. Such messages may also be monitored and recorded and used in accordance with our Privacy Policy [hyperlink].

You authorize American Modern to send autodialed, pre-recorded, and artificial voice calls and/or text messages to the phone number you have provided to American Modern, or subsequently provide to American Modern, as long as you are enrolled in Messaging Services.

You agree not to make any unlawful or unauthorized use of Messaging Services. You also agree not to send any inappropriate content, such as advertising, expletives, threatening, unlawful, discriminatory, libelous, obscene, sexually explicit, or partisan-political content, or content that infringes on the rights of any third party.

Opting Out of Messaging

You can turn off messaging in your American Modern Online Account settings or you can text reply  “STOP” to short code [●] anytime to an American Modern message to stop receiving text message from American Modern.

AMERICAN MODERN EXPRESSLY DISCLAIMS ANY AND ALL WARRANTIES OF ANY KIND, WHETHER STATUTORY, ORAL, WRITTEN, EXPRESS, OR IMPLIED. AMERICAN MODERN AND ITS AFFILIATES SHALL NOT BE RESPONSIBLE FOR OR HAVE ANY LIABILITY TO YOU OR ANY OTHER PERSON ARISING OUT OF OR IN ANY WAY RELATED TO YOUR PARTICIPATION IN THE MESSAGING PROGRAM.
